Terms

The rules for running votes, voting, and looking after the fans who trust you with their contact details.

1. The agreement

These terms are between you and Pull Up (Pull Up, 20 Bergsig Ave, Paarl, 7646, South Africa) (“Pull Up”, “we”). By using pullupnext.com you agree to them and to our privacy policy. Creators also agree to our data processing terms.

To vote you must be 16 or older. To run votes you must be old enough to enter a contract where you live (usually 18).

2. A vote is not a promise

Voting is free and doesn't commit anyone to anything. A creator decides whether, where and when to pull up. If a creator announces an event, the event is theirs: its venue, safety, tickets and changes are between them and the people who go. Pull Up isn't the organiser of any event.

3. Creators and fan contacts

Fans give you their contact details to vote, and some agree to hear from you. That trust is the whole product, so:

  • Use fan contacts only for what fans agreed to: messages about your pull ups, events and votes, on the channels they opted into.
  • Don't sell, rent, share or hand over your fan list, and don't add it to other mailing lists or ad audiences.
  • Honour unsubscribes everywhere you hold a copy, including exported CSVs.
  • Follow the anti-spam and data protection laws that apply to you and your fans (for example POPIA, GDPR, PECR and CAN-SPAM).
  • Answer fans' requests about their data; we'll help.

Breaking these rules is grounds for suspending your account and deleting the affected data.

4. Fair voting

One person, one vote per vote. Don't vote with fake or other people's contact details, run bots, or buy votes. We hold votes that look automated or come in floods from one network, and creators can choose to count verified votes only. We may remove votes we believe are fake.

5. Accounts and handles

  • Keep your sign-in secure; you're responsible for what happens in your account.
  • Handles are first come, first served, but you can't impersonate someone or hold a handle that infringes a trademark. We may reassign handles that do, and some words are reserved.
  • Your votes are listed on Discover unless you turn that off for a vote. A vote taken off Discover is also kept out of search engines.

6. Acceptable use

Don't use Pull Up to:

  • send spam, or message people who didn't opt in;
  • promote anything illegal, hateful, violent or sexually explicit, or events that put people in danger;
  • harass anyone, or collect data about fans for purposes they didn't agree to;
  • scrape the site, overload it, probe its security or get around its limits.

7. Your content

You own what you upload (photos, covers, text). You give us a licence to host and show it on Pull Up and in share cards, and to use your public profile and live votes to show what Pull Up does (for example on Discover). You confirm you have the rights to what you upload.

8. Pro and billing

Pull Up is free. Pro costs $19 a month or $190 a year, plus any tax, and renews automatically until you cancel. Our reseller and merchant of record is Paddle: you buy Pro from Paddle under its buyer terms, Paddle handles payment, invoices and sales tax, and its name may appear on your statement.

  • Cancel anytime from your billing page. You keep Pro until the end of the period you've paid for.
  • Refunds follow our refund policy.
  • Plan limits (for example 1,000 emails a month on Free and 25,000 on Pro) are in pricing. If you move back to Free, votes that are already live keep running, but new ones follow Free's limits.
  • We'll give at least 30 days' notice by email before a price change applies to you.

9. The service

We work hard to keep Pull Up running and your messages delivered, but we can't promise it will always be available or that every message arrives: inboxes and messaging apps filter and limit messages in ways we don't control. We may change or retire features; if a change takes away something you pay for, we'll tell you first.

10. Ending things

You can stop using Pull Up and delete your account at any time. We may suspend or close accounts that break these terms, or when the law requires it, and will tell you why unless we can't. When an account is deleted, its votes, fans and messages are deleted too.

Your fan list is yours whatever your plan. Before you delete your account you can download all of it as a CSV from Settings. If we ever close Pull Up, we'll give you at least 30 days' notice and a way to download your full fan list first.

11. Liability

Pull Up is provided “as is”. To the extent the law allows, we aren't liable for indirect or consequential losses, lost profits, or events that creators run, and our total liability to you is limited to what you paid us in the 12 months before the claim (or $100 if you use the free plan). Nothing here limits rights you have under consumer law that can't be excluded.

Creators are responsible for their votes, events and messages, and agree to cover our reasonable costs if a claim against us comes from their breach of these terms or the law.

12. Law and changes

These terms are governed by the laws of South Africa, without affecting mandatory consumer protections where you live. If we change them in a way that matters, we'll update the date at the top and email creators before the change takes effect. Questions: hello@pullupnext.com.
